The following SHORT TERM RENTAL AGREEMENT must be agreed to rent the cabin
SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Scott Silaika (“Homeowner”) and
(“Guest”) as of the date set forth on this Agreement. For good and valuable consideration, the sufficiency of which is
acknowledged, the parties hereby agree as follows:
Check-in: 3:00 PM. Please inspect the cabin upon arrival - if anything is not acceptable please call homeowner within 2
hours of arrival.
Early Check-in or late Check-out requires written pre-approval. Unlikely during peak summer season since cleaners
are scheduled in advance for 10AM checkout. Unapproved late checkouts may be charged $100/hr.
Check-out: 10:00 AM.

1. RENTAL RULES: Guest agrees to abide by the Rental Rules at all times while at the Property and shall cause all
members of the Rental Party and anyone else Guest permits on the property to abide by the following rules at all times
while at the property.
a. Guest and any additional permitted guests shall use the Property for residential purposes only and in a careful
manner to prevent any damage or loss to the Property; keep the Property in clean and sanitary condition at all times;
and refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use
the Property for any immoral, offensive or unlawful purposes, nor violate any law, nor commit waste or nuisance on or
about the Property.
b. NO PARTIES - there will be a $500 fee for unauthorized parties and it will result in eviction without refund.
c. Smoking is allowed outside only. Dispose of cigarette butts properly or they are considered littering, as well as a
potential safety / fire hazard.
d. Pets are not allowed. For service animals, please answer the following questions 1. is the service animal required
because of a disability? and 2. what work or task has the animal been trained to perform? Guest remains liable for any
and all damage caused by a service animal and service animals must be harnessed, leashed, or tethered, unless
these devices interfere with the service animal’s work or the individual’s disability prevents using these devices. In that
case, the individual must maintain control of the animal through voice, signal, or other effective controls. * The animal
must be under control of the handler at all times therefore never left alone at any time. * All waste must be properly
disposed of and indoor piddle pads are not allowed. We can ask you to remove your assistance animal and or leave
for excessive barking, aggressive or damaging behavior or obvious lack of sanitation. Please keep your assistance
animal off of the furniture. If we discover a guest has misrepresented a pet as a service animal, we reserve the right to
seek financial restitution of $500, report fraudulent claims to authorities and to evict the guest(s) without further notice
and no refund.
e. Beach: The beach is a public shared beach for nearby residents that closes at dusk. There is no lifeguard present.
Guest agrees to use all facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
f. Housekeeping: There is no daily housekeeping service included.
g. Heat and air conditioning: electric baseboard heat, AC in main room and bedrooms.
h. Water and Septic: The cabin is on well water and a septic system. Well water is potable, though not chemically
treated. Septic system is fragile, Guest agrees not to flush anything other than the supplied rapid dissolve toilet paper.
i. Fire pit: Use at your own risk, Homeowner is not liable for injury or destruction of property from misuse. Dried wood
may be available or can be purchased locally. Ashes may be left in the fire pit or cold ashes go in the metal can near
shed. Guest acknowledges that use of fire pit may be potentially dangerous and involve potential risks if improperly
used, particularly with regard to children, and such use is at the Guest’s own risk.
j. Trash collection: Please use supplied garbage bags, tie tightly and place inside either of the two large garbage cans
outside and secure the lid. If the outside garbage is full, inform Homeowner to have the garbage collected.
k. Recycling: All plastic, glass, paper and metal can be placed in a bag, must be clean, and can be left in the cabin or
placed in the shed.
l. Quiet time at 9 PM to 9 AM, no amplified music outside.
m. Violation of any house rules may result in forfeiture of the security deposit, eviction without refund, and additional
charges for damages.
2. Rental Party: The Rental Party shall consist of Guest and up to three (3) additional persons unless otherwise
agreed in writing by Homeowner. All persons are obligated to abide by the terms of this rental agreement, including the
Rental Rules. People other than those in the Rental Party set forth above may not stay overnight in the property. Any
person in or on the property is the sole responsibility of Guest and by accepting this reservation, it is agreed that the
Guest is expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to
use the premise.
3. Rental Fees: Acceptable payment methods include cash, personal check, third Party processors (AirBnB,
VRBO, HomeAway, TripAdvisor, etc.) or as otherwise agreed with Homeowner. PAYMENT OF THE RENTAL FEE IN
PART OR WHOLE CONSTITUTES ACCEPTANCE OF ALL TERMS OF THIS AGREEMENT.
a. Rental Fee. Payment in full or part is due according to Appendix A or the agreed terms on the third party
booking site. The cabin will be reserved only upon receipt of the above Rental Fee, or as agreed in Appendix A.
b. Deposit: A security Deposit may be due according to Appendix A or the agreed terms on the third party
booking site. The deposit shall be refunded within seven days of the Checkout Date provided no deductions are made
due to damage to the property or furnishings; dirt or other mess requiring excessive cleaning; or any other cost
incurred by Homeowner solely due to Guest’s stay. If the premises appear dirty or damaged upon Check-in, Guest
shall inform Homeowner immediately. The security deposit may not be enough to cover all damages and if it is found
the Rental Rules were not followed you could be charged for damages beyond the security deposit. Failure to follow
house rules may result in forfeiture of the deposit.
4. CANCELLATION: If Guest wishes to cancel his/her reservation, the Security Deposit shall be refunded. Host is
under no obligation to refund the Rental Fee but may do so if a) a suitable replacement rental is secured; or b)
otherwise agreed in writing.
5. INSURANCE: We encourage all renters to purchase traveler insurance. Some insurance included or
purchased on third party websites (such as AirBnB, HomeAway, VRBO) may not be sufficient and may not provide
sufficient coverage. Homeowner agrees to carry property and liability insurance.
6. RISK OF LOSS AND INDEMNIFICATION: Guest agrees that all personal property, furnishings, personal affects
and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of
Guest with regard to any theft, damage, destruction or other loss and Homeowner shall not be responsible or liable for
any reason whatsoever. Guest hereby covenants and agrees to indemnify and hold harmless Homeowner and their
agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal
fees and other actions for any damages, costs, attorney’s fees incurred by Guest, permitted guests, visitors or agents,
representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss
of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save
and hold Homeowner harmless in all such cases.
7. DEFAULT: If Guest should fail to comply with the conditions and obligations of this Agreement, including Rental
Rules, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good
order and free of damage. No refund of any portion of the Rental Fee or Deposit shall be made and if any legal action
is necessary, Homeowner shall be entitled to reimbursement from Guest for all costs incurred.
8. ASSIGNMENT OR SUBLEASE: Guest shall not assign or sublease the Property or permit the use of any
portion of the Property by other persons who are not family members or guests of the Guest and included within the
number of and as permitted occupants under this Agreement.
9. RELEASE: Guest hereby waives and releases any claims against Homeowner, the Property owner and their
successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be
sustained by Guest on or near or adjacent to the Property or beach facilities. Guest agrees to use all facilities or
amenities entirely at the Guest’s own initiative, risk and responsibility.
10. ENTRY AND INSPECTION: Homeowner reserves the right to enter the Property at reasonable times and with
reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective
purchasers, renters or other authorized persons. If Homeowner has a reasonable belief that there is imminent danger
to any person or property, Homeowner may enter the Property without advance notice.
11. UNAVAILABILITY OF PROPERTY: In the event the Property is not available for use during the Rental Term
due to reasons, events or circumstances beyond the control of Homeowner, Homeowner shall immediately return
payments for unused days that are made by the Guest, whereupon this Agreement shall be terminated and Guest and
Homeowner shall have no further obligations or liabilities in any manner pertaining to this Agreement.
12. GENERAL PROVISIONS: This Agreement contains the entire agreement between the parties with regard to
the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in
writing and signed by both the Guest and the Homeowner. This Agreement shall be governed by the laws of the State
of New York. The words “Homeowner” and “Guest” shall include their respective heirs, successors, representatives.
The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or
any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the
Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing.
